HOUSELEASINGCONTRACT
Lessor(hereinafterreferredtoas“PartyA”):
Lessee(hereinafterreferredtoas“PartyB”):
IncompliancewiththeContractLawofthePeople’sRepublicofChinaandRegulationofFlatLeasingofMunicipality,bothPartiesthroughamicableconsultationonthebasisofpartyautonomy,equalityandgoodfaith,agreeonthefollowingtermsandconditionsastothetenancyherein:
1.LocationofthePremises
PartyAwillleasetoPartyBthepremisesandattachedfacilitiesownedbyitselfwhichislocatedatandingoodconditionfor.
2.SizeofthePremises
Theregisteredsizeoftheleasedpremisesissquaremeters.
3.LeaseTerm
Theleasetermwillbefrom(month)(day)(year)to(month)(day)(year).PartyAwillclearthepremisesandprovideittoPartyBforusebefore(month)(day)(year).
4.Rental
(1)Amount:
therentalwillbepermonth(includingmanagementfees).PartyBwillpaytherentaltoPartyAintheformof.
(2)Paymentofrentalwillbeoneinstallmenteverymonth(s).Thefirstinstallmentwillbepaidbefore(month)(day)(year).
Eachsuccessiveinstallmentwillbepaidby(day)ofeachmonth.PartyBwillpaytherentalbeforeusingthepremisesandattachedfacilities(IncasePartyBpaystherentalintheformofremittance,thedateofremittingwillbethedayofpaymentandtheremittancefeewillbebornebytheremitter.)PartyAwillissueawrittenreceiptafterreceivingthepayment.
(3)Incasetherentalismorethandaysoverdue,PartyBwillpaypercentofmonthlyrentalasoverduefineeveryday,iftherentalbepaiddaysoverdue,PartyBwillbedeemedtohavewithdrawnfromthepremisesandbreachtheContract.Inthissituation,PartyAhastherighttotakebackthepremisesandtakeactionsagainstpartyB’sbreach.
5.OtherExpenses
PartyBwillpayallthefeesastowater,electricity,gasandtelecommunicationontimeinaccordancewiththebillsduringtherentalperiod.
PartyBshallpaythepropertymanagementfeeforthepremisesaccordingtotherulesontime.
PartyBagreestopaythemaintenancefeeduetoitsunreasonableusingoftheproperty,appliancesandutilities.
6.Deposit
Guarantyingthesafetyandgoodconditionsofthepremisesandattachedfacilitiesandaccountofrelevantfeesaresettledonscheduleduringtheleaseterm,partyBwillpaytopartyAasadepositbefore(month)(day)(year).PartyAwillissueawrittenreceiptafterreceivingthedeposit.
UpontheexpiryorsoonerdeterminationofthisContractandtherestitutionofthepropertybyPartyBtoPartyA,PartyAshall,subjecttotheconditionthatPartyBhasdulypaidallrentals,miscellaneousexpensesandotherchargespayabletoPartyAinaccordancewiththestipulationsofthisContract,returntheSecurityDepositwithoutinteresttoPartyB.
Thecompensation,damagesandunpaidrentalresultingfromtheterminationduetothebreachofthetermshereinbyPartyB,willbedeductedbythePartyAfromtheSecurityDeposit,theshortfallafterthedeductingwillbecomplementedbyPartyBwithintenworkingdaysafterreceivingthenoticefromPartyA.
7.ObligationsofPartyA
PartyAwillprovidethepremisesandattachedfacilities(seetheappendixoffurniturelistfordetail)onscheduletoPartyBforusing.
Incasethepremiseandattachedfacilitiesaredamagedbyqualityproblems,naturaldamagesoraccidents,PartyAwillberesponsibletorepairandpaytherelevantexpenses.IfPartyAcan’trepairthedamagedfacilitiesintwoweekssothatPartyBcan’tusethefacilitiesnormally,PartyBhastherighttoterminatetheContractandPartyAmustreturnthedeposit.
PartyAwillguaranteetheleaserightofthepremises.IncaseofoccurrenceofownershiptransferinwholeorinpartandotheraccidentsaffectingtherightofleasebypartyB,partyAshallguaranteethatthenewowner,andotherassociated,thirdpartiesshallbeboundbythetermsofthisContract.Otherwise,PartyAwillberesponsibletocompensatepartyB’slosses.
PartyAmustregisterthisContractwiththerelevantgovernmentauthority.IfnotdoingsoresultingthatthisContractisinvalidorPartyB’srightofleasingmaybedamaged,PartyAshouldtaketheallresponsibilities.PartyAshouldalsobearalltherelevanttaxes.
8.ObligationsofPartyB
FulfillingallitsobligationsunderthisContractincludingpayingpunctuallytoPartyAtherentalfeesandexpensesforheatingandairconditioninginrespectoftheLeasedPremisesaswellaspayingdirectlytotherelevantauthoritiesexpensesforwater,electricityandgasifpossible;
PartyBmayaddnewfacilitieswithPartyA’sapproval.Whenthiscontractexpires,PartyBmaytakeawaytheaddedfacilitieswithoutchangingthegoodconditionsofthepremisesfornormaluse,properinsuranceshallbearrangedaccordinglybyPartyBatitsownexpense;
Nottouseanygasofelectricappliancestheuseofwhichexceedstheexistingnetwork;Nottoraiseanyobjectionsinrespectof,orinterferewiththeuse,operation,managementorleasingofanypartofthebuildingwhichisnotpartofLeasedPremisesunderthisContract;
Arrangingandputtingintooperationfireprevention,safely,andsecuritymeasureswithintheLeasedPremises;
InformingPartyAimmediatelyincaseoffire,accidentsofanyotheremergencysituationinthebuildingoftheLeasedPremises,orincaseofanydefectthereinorinanyfixturesorequipmentsthereof;
ProvidingotherassistancetoPartyAuponitsrequestinconnectionwiththeLeasedPremisessubjecttotermsandconditionstobeagreedbetweentheParties.
PartyBwillnottransfertheleaseofthepremisesorsubletitwithoutPartyA’sapprovalandshouldtakegoodcareofthepremises.Otherwise,PartyBwillberesponsibletocompensateanydamagesofthepremisesandattachedfacilitiescausedbyitsfaultandnegligence.
9.TerminationandDissolutionoftheContract
(1)WithinonemonthbeforetheContractexpires,PartyBwillnotifyPartyAifitintendstoextendthelease.Inthissituation,twopartieswilldiscussmattersovertheextension.UnderthesametermsPartyBhastheprioritytoleasethepremises.
(2)Whentheleasetermexpires,PartyBwillreturnthepremisesandattachedfacilitiestoPartyAwithindays.AnybelongingsleftinitwithoutPartyA’spreviousunderstandingwillbedeemedtobeabandonedbyPartyB.Inthissituation,PartyAhastherighttodisposeofitandPartyBwillraisenoobjection.
(3)ThisContractwillbeeffectiveafterbeingsignedbybothparties.AnypartyhasnorighttoterminatethisContractwithoutanotherparty’sagreement.AnythingnotCoveredinthisContractwillbediscussedseparatelybybothparties.
10.BreachoftheContract
(1)Duringtheleaseterm,anypartywhofailstofulfillanyarticleofthisContractwithouttheotherparty’sunderstandingwillbedeemedtobreachtheContract.Bothpartiesagreethatthedefaultfinewillbe.Incasethedefaultfineisnotsufficienttocoverthelosssufferedbythefaultlessparty,thepartyinbreachshouldpayadditionalcompensationtotheotherparty.
(2)BothpartieswillsolvethedisputesarisingfromexecutionoftheContractorinconnectionwiththeContractthroughfriendlyconsultation.Incasetheagreementcannotbereached,anypartymaysummitthedisputetothecourtthathasthejurisdictionoverthematter.
(3)ThisContractwillbeeffectiveafterbeingsignedbybothparties.AnypartyhasnorighttoterminatethisContractwithoutanotherparty’sagreement.AnythingnotcoveredinthisContractwillbediscussedseparatelybybothparties.
11.Miscellaneous
(1)AnyannexistheintegralpartofthisContract.TheannexandthisContractareequallyvalid.
(2)TherearetwooriginalsofthisContract.Eachpartywillholdoneoriginal(s).

2.EffectivenessConditions
TheLeaseperiodaforementionedinClause1shallbeeffectiveasofthedatetheLessorcompletesalldetailsasinClause3,andnotifiestheLesseeinwritingwithintendaysthereof.

TheLessorandLesseeagreetocompleterepairoftheshophouseinaccordancewiththefollowingdetails:

TheLesseeagreestopayrenttotheLessorbyorbeforethedayofeverymonth.ShouldtheLesseebeindefaultofrentpaymentwithinthesaidperiod,theLesseeagreesthatthiscontractthenbecomesextinctwithoutanynotification.
Onthiscontractsigningdate,theLessorhasreceivedadepositasrentsecurityamountingto.
IfLesseeshallfailtoeffectpunctualpaymentofrentasagreed,Lesseeshallpayanoverduefineequivalentto0.5‰ofthemonthlyrenttothelessorforeachdayofdelay.
TheLesseeagreestopayrentandalltelephonebillstotheTelephoneorganizationoffromthedayoftheenforcementofthisContract.
