GeneralProvisions
Article1ThepresentLawisformulatedfortheprotectionofthelegitimaterightsandinterestsofconsumers,maintenanceofthesocio-economicorderandpromotionofthehealthydevelopmentofthesocialistmarketeconomy.
Article2TherightsandinterestsofconsumersinpurchasingandusingcommoditiesorreceivingservicesfordailyconsumptionshallbeundertheprotectionofthepresentLaw,orundertheprotectionofotherrelevantlawsandregulationsinabsenceofstipulationsinthisLaw.
Article3Businessoperatorsshall,intheirsupplyofcommoditiesproducedandsoldbythemorservicestoconsumers,abidebythepresentLaw,orabidebyotherrelevantlawsandregulationsinabsenceofstipulationsinthepresentlaw.
Article4Intransactionsbetweenbusinessoperatorsandconsumersaprincipleofvoluntariness,equality,fairness,honestyandcredibilityshallbefollowed.
Article5TheStateshallprotectthelegitimaterightsandinterestsofconsumersfrominfringement.
TheStateshalladoptmeasurestosafeguardconsumers'
exerciseoftheirrightsinaccordancewiththelawandtomaintainthelegitimaterightsandinterestsofconsumers.
Article6Itisthecommonresponsibilityofthewholesocietytoprotectthelegitimaterightsandinterestsofconsumers.
TheStateshallencourageandsupportallorganizationsandindividualstoexercisesocialsupervisionoveractsinfringinguponconsumerrightsandinterests.
Massmediashallconductpropagandadefendingthelegitimaterightsandinterestsofconsumersand,throughpublicopinion,exercisesupervisionoveractsinfringinguponthelegitimaterightsandinterestsofconsumers.
ChapterII
RightsofConsumers
Article7Consumersshall,intheirpurchasingandusingcommoditiesorreceivingservices,enjoytherightoftheinviolabilityoftheirpersonalandpropertysafety.
Consumersshallhavetherighttodemandbusinessoperatorstosupplycommoditiesandservicesuptotherequirementsforpersonalandpropertysafety.
Article8Consumersshallenjoytherighttoobtaintrueinformationofthecommoditiestheypurchaseanduseortheservicestheyreceive.
Consumersshallhavetherighttodemandbusinessoperators,inlightofthedifferentconditionsofcommoditiesorservices,toprovidetheirprices,origin,manufacturers,usage,functions,standards,grades,mainingredients,dateofproduction,termofvalidity,certificatesofinspection,operationinstructions,aftersaleservicesorinformationrelatingtocontents,standardsandcostsoftheservices.
Article9Consumersshallenjoytherightoffreechoiceofcommoditiesorservices.
Consumersshallhavetherighttomakeafreechoiceofbusinessoperatorsforsupplyofcommoditiesorservices,selectfreelyamongvarietiesofarticlesorformsofservicesanddecideindependentlytobuyornottobuyanykindofcommodities,ortoacceptornottoacceptanyitemofservices.
Consumersshallhavetherighttomakecomparisons,differentiationsandselectionswhentheymakeafreechoiceofcommoditiesorservices.
Article10Consumersshallenjoytherightoffairdeal.
Consumersshall,intheirpurchasingcommoditiesorreceivingservices,havetherighttoobtainfairdealprerequisitessuchasguaranteeofquality,reasonablepricesandcorrectmeasurement,andhavetherighttorefuseanycompulsorytransactionofbusinessoperators.
Article11Consumerssufferingfrompersonalinjuryorpropertydamageresultingfromtheirpurchasingorusingofcommoditiesorreceivingofservicesshallhavetherighttodemandcompensationsinaccordancewiththelaw.
Article12Consumersshallhavetherighttoformpublicorganizationsforthemaintenanceoftheirownlegitimaterightsandinterestsaccordingtolaw.
Article13Consumersshallhavetherighttoacquireknowledgeconcerningconsumptionandprotectionofconsumerrightsandinterests.
Consumersshallmakeeffortstomastertheknowledgeoftheirnecessarycommoditiesorservicesandtheskillinoperationthereof,applythecommoditiesinacorrectwayandraisetheirconsciousnessofself-protection.
Article14Consumersshall,intheirpurchasingandusingcommoditiesorreceivingservices,havetherightthattheirhumandignity,nationalcustomsandhabitsarerespected.
Article15Consumersshallhavetherighttoexercisesupervisionovercommodities,servicesaswellastheworkofprotectionofconsumerrightsandinterests.
ConsumersshallhavetherighttoinformandchargeagainsttheinfringementuponconsumerrightsandinterestsandthebreachoflaworneglectofdutyonthepartofStateorgansandtheirfunctionariesintheworkofprotectionofconsumerrightsandinterests,andhavetherighttoraisecriticismoforproposalsfortheworkofprotectionofconsumerrightsandinterests.
ChapterIII
ObligationsofBusinessOperators
Article16Businessoperatorsshall,intheirsupplyofcommoditiesandservicestoconsumers,fulfilltheirobligationsstipulatedintheLawofthePeople'
sRepublicofChinaonProductQualityandotherlawsandregulationsconcerned.
Incaseanagreementisreachedbetweenbusinessoperatorsandconsumers,thebusinessoperatorsshallfulfilltheobligationsagreeduponintheagreement;
buttheagreementbetweenthetwopartiesshallnotcontravenetheprovisionsoflawsandregulations.
Article17Businessoperatorsshalllistentotheconsumers'
opinionsonthecommoditiesandservicestheysupplyandacceptconsumers'
supervision.
Article18Businessoperatorsshallguaranteethatthecommoditiesandservicestheysupplymeettherequirementsforpersonalorpropertysafety.Astocommoditiesandservicesliabletoharmpersonalorpropertysafety,businessoperatorsshallgivetheconsumerstruthfulexplanationandclear-cutwarnings,andshallexplainorindicatethecorrectwaysofusingthecommoditiesorreceivingservicesaswellasthemethodsofpreventingdamage.
Businessoperatorsshall,upondiscoveryofseriousdefectsofthecommoditiesorservicestheysupplywhichareliabletoharmpersonalorpropertysafetyeventhoughthecommoditiesarecorrectlyappliedorservicesarereceivedinacorrectway,immediatelyreporttotheadministrativedepartmentsconcernedandinformtheconsumers,andadoptmeasurestopreventdamage.
Article19Businessoperatorsshallprovideconsumerswithauthenticinformationconcerningtheircommoditiesorservices,andmaynotmakeanyfalseandmisleadingpropaganda.
Businessoperatorsshallgivetruthfulanddefiniterepliestoinquiriesfromconsumersaboutthequalitiesofthecommoditiesorservicestheysupplyandtheoperationmethodsthereof.
Shopsshallmarkclearlythepricesofthecommoditiestheysupply.
Article20Businessoperatorsshallindicatetheirrealnamesandmarks.
Businessoperatorswholeasecountersorgroundsfromothersshallindicatetheirownrealnamesandmarks.
Article21BusinessoperatorswhosupplycommoditiesorservicesshallmakeoutforconsumersinvoicesforpurchasesordocumentsofservicesinaccordancewithrelevantregulationsoftheStateorcommercialpractices;
businessoperatorsmustproducesuchinvoicesordocumentswhereconsumerssodemand.
Article22Businessoperatorsshallguaranteethequality,functions,usageandtermofvaliditywhichthecommoditiesorservicestheysupplyshouldpossessundernormaloperationoracceptance,exceptthatconsumersareawareofthedefectsbeforetheybuythecommoditiesorreceivetheservices.
Businessoperatorswhoemployadvertisements,productinstructions,samplesorotherwaystodisplaythequalitystateoftheircommoditiesorservicesshallguaranteethattheactualqualityofthecommoditiesorservicestheysupplyisinconformitywiththatdemonstrated.
Article23Businessoperatorswhoareundertheobligationofrepairorcaveatvenditor,orotherresponsibilitiesinaccordancewithregulationsoftheStateoragreementswithconsumersshallcarryoutsuchobligationscorrespondinglyaccordingtosuchregulationsoragreements,andmaynotdeliberatelydelayorunreasonablyrefusetodoso.
Article24Businessoperatorsmaynot,throughformatcontracts,notices,announcements,entrancehallbulletinsandsoon,imposeunfairorunreasonablerulesonconsumersorreduceorescapetheircivilliabilityfortheirinfringementofthelegitimaterightsandinterestsofconsumers.
Formatcontracts,notices,announcements,entrancehallbulletinsandsoonwithcontentsmentionedintheprecedingparagraphshallbeinvalid.
Article25Businessoperatorsmaynotinsultorslanderconsumers,maynotsearchthebodyofconsumersorthearticlestheycarrywiththem,andmaynotviolatethepersonalfreedomofconsumers.
ChapterIV
ProtectionoftheLegitimateRightsandInterestsofConsumersbytheState
Article26TheStateshallheedtotheopinionsanddemandsfromconsumerswhenmakinglaws,regulationsandpoliciesconcerningconsumerrightsandinterests.
