3.RemunerationofLabour

Hours&Rest&Vocation
normalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffivedaysperweek,foranaverageoffortyhoursperweek.
EmployeeisentitledtoalllegalholidaysandotherpaidleavesofabsenceinaccordancewiththelawsandregulationsofthePRCandthepany’sworkrules.
c.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee,buttheextendedworkinghourforadayshallgenerallynotexceedonehour;Ifsuchextensioniscalledforduetospecialreasons,the
extendedhoursshallnotexceedthreehoursa,thetotalextensioninamonthshallnotexceedthirty-sixhours.
Security&Welfare
Employerwillpayforallmandatorysocialsecurityprogramssuchpensioninsurance,unemploymentinsurance,medicalinsuranceoftheEmployeeaccordingtotherelevantgovernmentandcityregulations.

EmployershouldprovidetheEmployeewithoccupationalsafetyandhealthconditionsconformingtotheprovisionsoftheStateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess.
EmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspecializedoperationsshouldreceivespecializedtrainingandacquirequalificationsforsuchspecialoperations.
c.TheEmployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork.
Discipline
EmployermaydraftbylawsandlabourdisciplinesoftheCompany,Accordingtowhich,the
EmployershallhavetherighttogiverewardsortakedisciplinaryactionstotheEmployee;
EmployeeshallplywiththemanagementdirectionsoftheEmployerandobeythebylawsandlabourdisciplinesoftheEmployer.
Employeeshallundertaketheobligationtokeepandnottodisclosethetradesecretforthe
EmployerduringtheperiodofthisContract;Thisobligationofconfidentialityshallsurvivethe
terminationofthisContractforaperiodoftwo
(2)years.
,Modification,RenewandDischargeoftheContract
a.TherelevantclausesoftheContractmaybemodifiedbytheparties:
specificclauseisrequiredtobemodifiedbythepartiesthrough
consultation;
totheforcemajeure,theContractcannotbeexecuted;
relevantlawsandregulationshavebeenmodifiedorabolishedbythetimeofsigningthe
Contract.
Contractmaybeautomaticallyterminated:
i)ThisContractisnotrenewedattheexpirationofthisContract;
ii)TheEmployerislegallyannouncedtobebankruptcy,dismissed,orcanceled;
iii)ThedeathoftheEmployeeoccurs;
iv)Theforcemajeuretakesplace;
v)TheconditionsofterminationagreedintheContractbythepartiesarise.
Contractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmentoftheprocedurewithin15daystotheexpiration;
d.TheContractmaybedischargedthroughconsultationbytheparties;
ContractmaybedischargedbytheEmployerwithimmediateeffectandtheEmployeewillnotbepensated:
Employeedoesnotmeetthejobrequirementsduringtheprobationaryperiod;
EmployeeseriouslyviolatesdisciplinesorbylawsoftheEmployer;
Employeeseriouslyneglectshisduty,engagesinmalpracticeforselfishendsandbrings
significantlosstotheEmployer;
Employeeisbeingpunishedbyphysicallabourforitsmisfeasance
Employeeisbeingchargedwithcriminaloffences:
ContractmaybeterminatedbytheEmployerbygivingnoticeinwrittenform30(thirty)daysinadvance:
Employeefailsillorisinjuredto(otherthanduetowork)andafterpletionofmedical
treatment,isnotabletoperformhispreviousfunctionoranyotherfunctiontheEmployerassignstohim;
Employeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily;
circumstanceshavemateriallychangedfromthedatethisContractwassignedtotheextentthatitisimpossibletoexecutetheContractprovided,however,thatthepartiescannotreachanagreementtoamendthecontracttoreflectthechangedcircumstances.
Employerisbeingconsolidatedinthelegalconsolidationperiodonthebrinkofbankruptcyorthesituationofbusinessisseriouslyintrouble,undersuchcondition,itisrequiredtoreducethe
emplouee.(inlegalprocedure)
Employeeshallnotbedismissed:
i.TheContracthasneitherexpirednorconformedto,,,;
EmployeeisillwithoccupationaldiseaseorinjuredduetoworkandhasbeenauthenticatedfullyorpartlydisabledbytheLabourAuthenticationCommissioninBaodiCounty,Tianjin.
iii.TheEmployeeisillorinjured(otherthanduetowork)andiswithintheperiodofmedicalleaveprovidedforbyapplicablePRClawandregulationsandCompanypolicy;
Employeeiswomanwhoispregnant,onmaternityleave,ornursingababyunderoneyearofage;or
applicablePRClawsandregulationsotherwiseprohibittheterminationofthisContract.
ContractmaybedichargedbytheEmployeebygivingnoticeinwrittenform30(thirty)daysinadvance.However,theEmployeemayinformtheEmployertodischargetheContractatrandomunderthefollowingoccasions:
Employeeisstillintheprobationaryperiod;
EmployerforcetheEmployeetoworkbyviolence,duressorillegalrestrictiontophysical
freedom;
iii.TheEmployerdoesnotpaytheremunerationoftheEmployeeaccordancewiththerelevantclauseintheContract;
EmployerviolatestherelevantregulationsofStateorTianjinforitsterriblesafeandhealth
condition,whichisharmfultotheEmployee’shealth.
ContractcannotbeterminatedbytheEmployeebeforetheexpirationifnotconformingto,,
j.TheEmployershallpaytheeconomicpensationtotheEmployeriftheContractisterminatedconformingto,,AdditionalfeeformedicalallowanceshouldbepaidtotheEmployeeiftheContractisterminatedconformingto
Liabilities
a.Duetoeitherparty’sfault,ifbreachingtheContract,thatpartyshallundertakethebreach
liabilityaccordingtotheextenttotheperformanceoftheContract;ifthepartiesbothbreachtheContract,theyshallundertakeitsseparateliabilityaccordingtotheconcretesituation.
b.Duetoeitherparty’sfault,ifbreachingtheContracttodamagetheotherparty.ThedamageshouldbepensatedbythefaultypartyaccordancewiththerelevantlawsandregulationsofPRC.
totheforcemajeure,causingthenon-performanceorthedamagestoeitherparty,theotherpartymaynotundertakethebreachliability;
EmployeewantstoresignandhasreceivedtrainingprovidedbytheEmployer,theEmployeeshallpensateforthetrainingcost.Themethodofpensationshouldbefixedaccordingtotherelevantpanyregulationsasfollows:

Disputes
WherealabordisputebetweenthepartiestakesplaceduringtheperformanceofthisContract,the
partiesconcernedmayseekforasettlementthroughconsultation;oreitherpartymayapplytothelabordisputemediationmitteeoftheirunitformediation;ifthemediationfailsandoneofthepartiesrequestsforarbitration,thatpartymayapplytothelabordisputearbitrationmitteeforarbitration.Eitherpartymayalsodirectlyapplytothelabordisputearbitrationmitteeforarbitrationwithin60daysstartingfromthedateoftheoccurrenceofalabordispute.Ifoneofthepartiesisnotsatisfiedwiththeadjudicationofarbitration,thepartymaybringthecasetoapeople’scourtwithin15daysofthedateofreceivingtherulingofarbitration
verificationofthisContractshallbemadeinBaodiLabourBureau,Tianjinwithin30daysafterbeingsignedbytheparties.
