RegulationsofthePeople’sRepublicofChinaonChinese-ForeignCooperationinRunningSchools(《中华人民共和国中外合作办学条例》英文版)
(Adoptedatthe68thExecutiveMeetingoftheStateCouncilonFebruary19,2003,promulgatedbyDecreeNo.372oftheStateCouncilofthePeople'sRepublicofChinaonMarch1,2003,andeffectiveasofSeptember1,2003)
ChapterIGeneralProvisions
Article1 TheseRegulationsareformulatedinaccordancewiththeEducationLawofthePeople'sRepublicofChina,theVocationalEducationLawofthePeople'sRepublicofChinaandtheLawofthePeople'sRepublicofChinaonPromotionofPrivately-RunSchoolsforthepurposesofstandardizingChinese-foreigncooperationinrunningschools,strengtheninginternationalexchangeandcooperationinthefieldofeducationandpromotingthedevelopmentoftheeducationalcause.
Article2 TheseRegulationsapplytotheactivitiesofthecooperationbetweenforeigneducationalinstitutionsandChineseeducationalinstitutions(hereinafterreferredtoasChineseandforeigncooperatorsinrunningschools)inestablishingeducationalinstitutions(hereinafterreferredtoasChinese-foreigncooperatively-runschools)withintheterritoryofChinatoprovideeducationservicemainlytoChinesecitizens.
Article3 Chinese-foreigncooperationinrunningschoolsisanundertakingbeneficialtopublicinterestsandformsacomponentofChina'seducationalcause.
ForChinese-foreigncooperationinrunningschools,theStateadoptsthepoliciesofopeningwidertotheoutsideworld,standardizationofrunningschools,exercisingadministrationaccordingtolawandpromotingitsdevelopment.
TheStateencouragesChinese-foreigncooperationinrunningschoolstowhichhigh-qualityforeigneducationalresourcesareintroduced.
TheStateencouragesChinese-foreigncooperationinrunningschoolsinthefieldofhighereducationandvocationaleducation,andencouragesChineseinstitutionsofhigherlearningtocooperatewithrenownedforeigninstitutionsofhigherlearninginrunningschools.
Article4 ThelegalrightsandinterestsofChineseandforeigncooperatorsinrunningschoolsandofChinese-foreigncooperatively-runschoolsshallbeprotectedbythelawsofChina.
Chinese-foreigncooperatively-runschoolsshallenjoypreferentialpoliciesmadebytheStateandenjoyautonomywhenconductingeducationalactivitiesinaccordancewithlaw.
Article5 Chinese-foreigncooperationinrunningschoolsshallabidebythelawsofChina,implementChina'seducationalpolicies,complywithChinesepublicethicsandshallnotjeopardizeChina'ssovereignty,securityandpublicinterests.
Chinese-foreigncooperationinrunningschoolsshallmeettheneedsofthedevelopmentofChina'seducationalcause,ensureteachingqualityandmakeeffortstotrainallkindsoftalentsforChina'ssocialistconstruction.
Article6 Chineseandforeigncooperatorsinrunningschoolsmaycooperatetoestablisheducationalinstitutionsofvarioustypesatvariouslevels.However,theyshallnotestablishinstitutionsofferingcompulsoryeducationserviceorspecialeducationservicessuchasmilitary,policeandpoliticaleducationservices.
Article7 Noforeignreligiousorganization,religiousinstitution,religiouscollegeanduniversityorreligiousworkermayengageincooperativeactivitiesofrunningschoolswithintheterritoryofChina.
Chinese-foreigncooperatively-runschoolsshallnotofferreligiouseducation,norconductreligiousactivities.
Article8 TheeducationadministrativedepartmentoftheStateCouncilshallberesponsibleforoverallplanning,comprehensivecoordinationandmacrocontrolforallChinese-foreigncooperativeactivitiesinrunningschoolsnationwide.Theeducationadministrativedepartment,thelabouradministrativedepartmentandotherrelevantadministrativedepartmentsoftheStateCouncilshallberesponsiblefortheworkinrelationtoChinese-foreigncooperationinrunningschoolsinaccordancewiththeirfunctionsanddutiesasdefinedbytheStateCouncil.
Theeducationadministrativedepartmentsofthepeople'sgovernmentsoftheprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentshallberesponsibleforoverallplanning,comprehensivecoordinationandmacrocontrolforallChinese-foreigncooperativeactivitiesinrunningschoolswithintheirrespectiveadministrativeregions.Theeducationadministrativedepartments,thelabouradministrativedepartmentsandotherrelevantadministrativedepartmentsofthepeople'sgovernmentsoftheprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentshallberesponsiblefortheworkinrelationtoChinese-foreigncooperationinrunningschoolswithintheirrespectiveadministrativeregionsinaccordancewiththeirfunctionsandduties.
ChapterIIEstablishment
Article9 AneducationalinstitutionwhichappliesforestablishingaChinese-foreigncooperatively-runschoolshallhavethelegalpersonstatus.
Article10 AChineseorforeigncooperatorinrunningaschoolmaycontributewithfunds,inkindorinformsofland-useright,intellectualpropertyrightsorotherassetstoestablishtheschool.
ContributionofintellectualpropertyrightsbyaChineseorforeigncooperatorinrunningaschoolshallnotexceedone-thirdofitstotalcontribution.However,foraforeigneducationalinstitutionthatcomestoChinaforcooperationinrunningaschoolattheinvitationoftheeducationadministrativedepartmentorthelabouradministrativedepartmentoftheStateCouncilorattheinvitationofthepeople'sgovernmentofaprovince,anautonomousregionoramunicipalitydirectlyundertheCentralGovernment,itscontributionintheformofintellectualpropertyrightsmayexceedone-thirdofitstotalcontribution.
Article11 AChinese-foreigncooperatively-runschoolshallmeetthebasicrequirementsprescribedbytheEducationLawofthePeople'sRepublicofChina,theVocationalEducationLawofthePeople'sRepublicofChina,theHigherEducationLawofthePeople'sRepublicofChinaandotherlawsandadministrativeregulations,andshallhavethelegalpersonstatus.However,aChinese-foreigncooperatively-runschoolestablishedtoofferhighereducationservicethroughthecooperationbetweenaforeigneducationalinstitutionandaChineseinstitutionofhigherlearningwhichofferseducationforacademicqualificationsmayhavenolegalpersonstatus.
TheestablishmentofaChinese-foreigncooperatively-runschoolshallfollowthestandardsfortheestablishmentofState-runeducationalinstitutionsofthesametypeandatthesamelevel.
Article12 AnapplicationforestablishingaChinese-foreigncooperatively-runschoolofferinghighereducationforacademicqualificationsatorabovetheregularuniversityeducationshallbesubjecttoexaminationandapprovaloftheeducationadministrativedepartmentoftheStateCouncil;anapplicationforestablishingaChinese-foreigncooperatively-runschoolofferingspecializedhighereducationorhighereducationfornon-academicqualificationsshallbesubjecttoexaminationandapprovalofthepeople'sgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentwheretheproposedschoolistobelocated.
AnapplicationforestablishingaChinese-foreigncooperatively-runschoolofferingsecondaryeducationforacademicqualifications,programsoftutoringself-taughtstudentsforexaminations,programsofferingsupplementaryteachingofschoolcoursesandpre-schooleducationshallbesubjecttoexaminationandapprovaloftheeducationadministrativedepartmentofthepeople'sgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentwheretheproposedschoolistobelocated.
AnapplicationforestablishingaChinese-foreigncooperatively-runschoolofferingvocationaltechnicaltrainingshallbesubjecttoexaminationandapprovalofthelabouradministrativedepartmentofthepeople'sgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentwheretheproposedschoolistobelocated.
Article13 TheestablishmentofaChinese-foreigncooperatively-runschoolshallincludetwostepsofpreparationforestablishmentandformalestablishment.However,theapplicantmayfileanapplicationdirectlyforformalestablishmentifitfulfillstheconditionsforofferingeducationandmeetsthestandardsforestablishment.
Article14 AnapplicantwhoappliesforpreparationforestablishmentofaChinese-foreigncooperatively-runschoolshallsubmitthefollowingdocuments:
(1)aprojectreportwhichshallmainlycontainthenamesoftheChineseandforeigncooperatorsinrunningtheschool,thenameoftheproposedcooperatively-runschool,educationaltargets,sizeoftheschool,levelandformofeducationtobeoffered,conditionsforofferingeducation,systemofinternalmanagement,sourcesoffundingandcapitalmanagementanduse,etc.;
(2)acooperativeagreementwhichshallcontainthedurationofcooperationandwaysofdisputesettlement,etc.;
(3)validdocumentsverifyingsourcesofassetsandamountofcapital,withclearstatementofownership;
(4)adonationagreementforanyassetsprovidedasadonationtotheproposedschool,whichcarriesthenameofthedonor,valueofdonation,purposeofuseandmanagementmethods,andtherelevantvalidverifyingdocuments;and
(5)acertificateverifyingthatnotlessthan15percentofinitialfundsprovidedbytheChineseandforeigncooperatorsisalreadyinvested.
Article15 Inthecaseofanapplicationforpreparationforestablishment
